1. PRELIMINARY & LEGAL CAPACITY
1.1. These Terms constitute a legally binding agreement between you and Lifestone Healthcare operating under the brand MedbeW.
1.2. You confirm that you are at least 18 years of age and legally competent to enter into this agreement.
1.3. These Terms govern use of the website, pharmacy, diagnostics, polyclinic, affiliate programs, and all related services.
1.4. You consent to receiving invoices, reports, prescriptions validation records, and legal communications electronically.
2. PHARMACY SERVICES & PRESCRIPTION CONTROLS
2.1. All pharmaceutical sales comply with the Drugs and Cosmetics Act, 1940 and Pharmacy Practice Regulations, 2015.
2.2. Schedule H, H1, and X drugs require valid original prescriptions.
2.3. Pharmacists reserve the right to refuse suspicious, tampered, or expired prescriptions.
2.4. Zero tolerance for unauthorized narcotic or psychotropic requests.
2.5. Risk in products transfers upon delivery. MedbeW is not liable for improper storage post-delivery.
3. POLYCLINIC & MEDICAL SERVICES
3.1. All consulting doctors are independent practitioners and not employees of MedbeW.
3.2. MedbeW acts solely as infrastructure provider and is not liable for clinical decisions or outcomes.
3.3. Website content does not constitute medical advice.
3.4. Telephonic, WhatsApp, SMS, or email communications are facilitative only.
3.5. Medical records are maintained per applicable regulations and may be released upon written request.
4. DIAGNOSTIC SERVICES
4.1. Diagnostics may be fulfilled through NABL-accredited partner labs.
4.2. Lab accuracy responsibility rests with the performing laboratory.
4.3. Results depend on patient compliance with preparation instructions.
5. USER INDEMNIFICATION & LIABILITY LIMITATION
5.1. Users indemnify MedbeW against claims arising from fake prescriptions, misuse, or fraud.
5.2. Total liability shall not exceed the amount paid for the specific service.
5.3. Indirect, incidental, consequential, or punitive damages are excluded.
5.4. Product defects remain the responsibility of manufacturers.
6. PRICING, PAYMENTS & REFUNDS
6.1. Final invoice price prevails over displayed price.
6.2. Orders cannot be cancelled after dispatch.
6.3. Medicines are non-returnable except damage or expiry at delivery.
6.4. Fraudulent chargebacks may result in legal recovery.
7. DATA PRIVACY & PLATFORM SECURITY
7.1. Data handling complies with the Digital Personal Data Protection Act, 2023.
7.2. Website access may be interrupted due to maintenance or technical issues.
7.3. All intellectual property belongs to Lifestone Healthcare.
8. PLATFORM MISUSE & TERMINATION
8.1. MedbeW may suspend accounts for fraud, abuse, harassment, or policy violation.
8.2. Suspended users forfeit promotional benefits.
9. AFFILIATE & REFERRAL PROGRAM
9.1. Referral partners act as independent marketing associates.
9.2. MedbeW is not liable for representations made by affiliates.
9.3. Commission payouts subject to fraud screening and order validation.
10. FORCE MAJEURE
10.1. MedbeW shall not be liable for delays due to events beyond reasonable control including natural disasters, pandemics, supply disruptions, strikes, or government actions.
11. DISPUTE RESOLUTION
11.1. Governed by the Laws of India.
11.2. Disputes shall be resolved by arbitration in Jamshedpur under the Arbitration and Conciliation Act, 1996.
11.3. Sole arbitrator appointed by MedbeW. Language: English.
11.4. Exclusive jurisdiction: Courts of Jamshedpur, Jharkhand.
11.5. Users waive class action participation.
